GENERAL TERMS OF SALE AND DELIVERY marketingspot ag Version 1.2 as of: 25.03.2013.
The German version of the Terms of Sale and Delivery is the only valid version.
These General Terms apply for all products, services and deliveries.
They are valid for all juridical and natural persons entering a business relationship with marketingspot ag.
Any contrary or deviating terms are only valid if agreed to by marketingspot ag in writing.
With the order the customer accepts these general terms. It is possible to print these General Terms separately at any time (link).

marketingspot ag reserves the right to alter, at any time, website, prices, models or services without prior notice.
1. GENERAL
All print orders are carried out on the basis of the data the customer transfers to marketingspot.
marketingspot ag does not accept liability for content, colour, text or picture errors. The customer is obliged to check the data before sending it.
marketingspot ag does not accept liability for possible alterations in colours due to non-conformity of the transferred data.
Please refer to the website for data format requirements.
Should the customer require a "final proof", it shall be treated and invoiced as a 1 piece order.
For large orders marketingspot ag reserves the right to conclude agreements deviating from the general payment terms.
2. PRICES
All prices are shown in Swiss Francs excluding VAT. Delivery costs are invoiced additionally. The actual prices are shown in the website. Backorders are invoiced at the prices when the item was ordered.
Legal duties are not invoiced separately; they are included in the prices where applicable. Prices shown on the website or in catalogues do not include possible decoration materials.
Errors and omissions in price, text or picture indications excepted.
3. SHIPPING
3.1 SHIPPING AND HANDLING COST FOR SWITZERLAND AND THE PRINCIPALITY OF LIECHTENSTEIN
Shipping and handling cost for parcels up to 1m: CHF 13.00 + VAT per parcel, for parcels over 1m: CHF 26.00 + VAT per parcel.
3.2 PICK UP
If the customer chooses to pick up the order at marektingspot's office, delivery and handling cost will not be charged.
3.3 DELIVERY SCHEDULE
The customer will receive a delivery date with the order confirmation. All deliveries are under reserve of stock situation of the suppliers. The customer is asked to check the order immediately upon receipt.
Should the parcel(s) arrive damaged the customer is asked to inform the transport company immediately, to make them sign a damage report and to mail it to retoure@marketingspot.ch.
The customer is asked to inform marketingspot within 8 days after receipt of the goods about obvious defects at retoure@marketingspot.ch.
As soon as the transport company picks up the goods marketingspot's responsibility ends.
3.4 SHIPPING FOR THE BENEFIT OF A THIRD PARTY
This is possible if the customer indicates a separate delivery address when placing the order.
3.5 PART DELIVERY
If an item is out of stock marketingspot informs the customer by mail. marketingspot reserves the right to make part deliveries. Delivery schedules are standard values.
Deliveries are under reserve of availability at the supplier's warehouse.
3.6 CANCELLING AN ORDER
Is only possible on written approval by marketingspot ag and on compensation of accrued costs.
3.7 SHIPPING COMPANY
marketingspot ag chooses the appropriate shipping company, at the moment „DHL“. The goods is shipped with Express Parcel Service: shipped today, delivery at the customer's address tomorrow.
For large orders marketingspot reserves the right to ship by lorry.
4. PAYMENT TERMS
4.1 PAYMENT TERMS FOR SWITZERLAND AND THE PRINCIPALITY OF LIECHTENSTEIN
After solvency check marketingspot ag ships against invoice.
Terms of payment: 10 days net.
Other terms of payment require a written agreement. With the order the customer agrees to a credit report.
For delay in payment marketingspot reserves the right to charge default interest of 1% per month as well as CH 10.00 for the second and CHF 15.00 for the third payment request.
Customers in default will automatically be excluded from INVOICE and submitted to a new solvency check.
5. PROPERTY RIGHTS
Unless the invoice is entirely paid, the goods remain the property of marketingspot ag. The customer is obliged to inform marketingspot about changements in address and/or name as long as there are open claims.
Should the customer sell the goods before the invoice is entirely paid, he assigns his claims to marketingspot ag to cover the open claims.
6. DEFECTS / COMPLAINTS / WARRANTY
6.1 DEFECTS
Should the goods be defective, the customer is asked to contact retoure@marketingspot.ch and get a RMA number and a claims form.
The customer is asked to fill in the form, mark the RMA number, join a copy of the invoice and send the defective goods to marketingspot's address.
Slight alterations in colours due to material and technology changes are no reasons for complaints.
6.2 WARRANTY
All items shown on www.marketingspot.ch are covered by a 24 months warranty on fabrication and material defects. Defective products will be repaired or replaced by an equal or similar product.
For all warranty claims the customer is asked to contact retoure@marketingspot.ch and get a RMA number and a claims form.
The customer is asked to fill in the form, mark the RMA number, join a copy of the invoice and send the defective goods to marketingspot's address.
Warranty is void should the customer carry out any modification or repairs or misuse the item.
6.3 RETURNS ADDRESS

6.4 LIABILITY
marketingspot ag does not accept liability for consequential damage due to defective products beyond the Swiss Law on Product Liability (www.admin.ch/ch/d/sr/2/221.112.944.de.pdf).
marketingspot ag does not accept any liability for consequential damage due to improper use of the item.
Warranty is limited to repairs or replacement of the item(s) bought on www.marketingspot.ch.
marketing spot does not accept any liability for costs incurred due to errors in texts, pictures, weight or measure indications of our suppliers or due to delay or failure of shipment.
The use of the website is at each customer's own risk.
6.5 NON-FULFILMENT OF ORDER
If an item is not available any longer and cannot be replaced by a substitute product, marketingspot reserves the right to renounce the order. Prepaid orders will be reimbursed.

7. PRIVACY POLICY
7.1 COMPANY POLICY AND PRIVACY POLICY
Security and privacy are marketingspot's most important concerns.
Personal data is collected according to Swiss Law on Protection of Data Privacy.
marketingspot's employees are bound to secrecy. marketingspot's contracting partners treat the data in strict confidence.
7.2 PERSONAL DATA
marketingspot stores personal data as long as they are used for the order fulfilment and for information and publicity reasons within the company/webshop no longer than 12 months.
marketingspot does not disclose any personal data to third parties unless they are needed for printing and transport.
With his order the customer automatically agrees to receiving information and offers from marketingspot ag.
Should the customer wish to receive neither informationen nor news from marketingspot ag, please mail to unsubscribe@marketingspot.ch.
7.3 COPYRIGHT
Before placing the order the customer has to make sure that his data does not infringe the copyright. marketingspot ag does not accept any liability on infringement of copyright.
The customer is liable for the copyright protection.
7.4 COOKIES
marketingspot uses cookies on the site www.marketingspot.ch. If the customer has turned off cookies within his browser it is still possible to order online.
7.5 PASSWORDS
In order to buy online on www.marketingspot.ch the customer needs a password. It is the customer's duty to store it safely.
7.6 LINKS
The use of links on this site is at the customer's own risk. marketingspot ag does not accept any liability for its contents.
8. TRADE MARKS / COPYRIGHT
These General Terms are copyright of marketingspot ag.
Without written approval they must not be used, copied or diclosed to third parties.
The use of these General Terms for commercial purposes may be prosecuted.
The website www.marketingspot.ch is intellectual property of marketingspot ag according to Swiss Law.
All pictures shown on www.marketingspot.ch are copyright of marketingspot ag. A reproduction of pictures without marketingspot's written permission may be prosecuted.
All logos, brand names and company names shown on www.marketingspot.ch are properties of the corresponding owners.
9. FINAL
The General Terms are valid in their German version at the date of the contract between customer and marketingspot ag. If one of the dispositions is void, the others remain valid.
10. LAW AND JURISDICTION
Contracts are concluded according to Swiss Law. Competence of court is Liestal, Basle District, Switzerland.
